All members of the House take an oath of office,
required by Article 6 of the United States Constitution, to be bound to support
the Constitution. On the first day of
the new Congress, the newly elected Speaker of the House administers the
following oath to all:
“I, (name), do solemnly swear (or affirm) that I will
support and defend the Constitution of the United States against all enemies,
foreign and domestic; that I will bear true faith and allegiance to the same;
that I take this obligation freely, without any reservation or purpose of
evasion; and that I will well and faithfully discharge the duties of the office
on which I am about to enter. So help me
God.”
How
many elected representatives take this oath with full knowledge of what it
means to hold true to it? Furthermore,
how many take the oath with no intention of fulfilling it?

Article 1, Section 2 of the
United States Constitution provides for the minimum and maximum sizes for the
House of Representatives.
The current size of the
House of Representatives was established by Public Law 62-5 on August 8, 1911
and took effect in 1913. That size
stands at 435 members.
The

Each state is entitled
to at least one Representative. A
state’s population determines apportionment of additional seats.
Congress fixes the size and the procedure for
apportioning the number of seats among the states.
State
legislatures determine the physical boundaries of congressional districts,
subject to constraints established by the Congress and the Supreme Court. (This is where reapportionment and
redistricting rulings come in.)
The
number of representative seats for each state is ultimately based on the
Department of Commerce’s decennial census.
Each
member of the U.S. House of representatives represents an average population of
646,952 – according to the 2000 Census.
Requirements
for membership in the U.S. House of Representatives, as set forth in Article I,
Section 2 of the Constitution, are:
“No person shall be a Representative who shall not have attained to
the age of twenty five years, and been seven years a citizen of the United
States, and who shall not, when elected, be an inhabitant of that state in
which he shall be chosen.”
General elections for the House are held on the Tuesday after the first
Monday in November of even-numbered years.
The first Tuesday in November
2014 is the date of the next general election.
At that time, each and every one of the 435 Representatives’ jobs will
be on the line.
We, the people, have the power to say who is to stay and who is to go.
Are you registered to vote?
In the event of a
vacancy in the House of Representatives, due to death, resignation, or
declination – The Constitution, Article I, Section 2, Clause 4, requires that
all vacancies be filled by election. If
a House seat becomes vacant during the first session of a Congress, all states
require special elections to fill it.
Procedures differ from state to state when seats become vacant during
the second session. This usually
depends on the time remaining before the next general election. Most states nominate House candidates by
primary election. In many states, if
there is no contender, no primary is held.
Major party candidates have automatic ballot access in all states for a
general election, but minor party and independent candidates must meet various
state requirements to be placed on the ballot.
Usually these requirements would include submission of petition
signatures of registered voters.

The Continental Congress, 1774-1789, established by ordinance the
Office of Delegate, which was confirmed by a law of Congress. Delegates from Territories or Districts
organized by law have been admitted to the House since the beginning of the
Republic.
Currently the District of Columbia, the Virgin Islands, Guam,
America Samoa, and for the first time in 2009, the Northern Marianna Islands
each send one Delegate to Congress every two years.
Congress created the post of Resident Commissioner – then applying
to Puerto Rico and the Philippines - in 1904.
Since 1946, only Puerto Rico has had a Resident Commissioner. The length of terms is the only difference in the two posts. Delegates serve two years and Resident
Commissioners serve four.
Delegates and the Resident Commissioner are not permitted to vote on the floor of the House, but they may participate in debates and serve on committees with equal power and privileges of the other Members.
